What the law requires you to be told before signing electronically

Before you agree to sign and receive documents electronically, the federal Electronic Signatures in Global and National Commerce Act (15 U.S.C. § 7001) requires that you are told the following. Please read it. If anything here does not suit you, say so — we will do it on paper instead, and it costs you nothing.

1. Your right to receive a paper copy

You may ask for a paper copy of any document we send you electronically, at any time, and we will provide it at no charge. Ask by email, by telephone, or in person.

2. Your right to withdraw consent

You may withdraw your consent to transact electronically at any time, before or after signing, and there is no fee and no penalty for doing so.

To withdraw it, tell us in any of the ways listed at the end of this page. We will confirm, and from then on we will send your documents on paper to the postal address on your record. Withdrawing your consent does not affect the validity of anything you have already signed electronically, and it does not affect the service agreement itself.

3. What your consent covers

Your consent covers the documents relating to marine service work on your vessel: the service agreement, any work authorization, change orders, invoices, statements, receipts, and notices connected to them. It does not commit you to anything else, and it can be given for a single document if that is what you prefer — tell us and we will treat it that way.

4. How to update your contact details

Tell us, by any of the means below, if your email address, telephone number or postal address changes. We send documents and signing codes to the address on your record, so an out-of-date one means you will not receive them.

5. What you need in order to read and keep these documents

To access and retain what we send you, you will need:

If these requirements change in a way that means you might no longer be able to read what we send, we will tell you and you may withdraw your consent then, without fee or penalty.

6. Keeping your copy

Every document you sign can be downloaded as a PDF at the moment you sign it, and we email you a copy as well. We recommend saving it. If you lose it, ask us and we will send it again.

7. What we record when you sign

So that both of us have a reliable record, we record the date and time, your IP address, the browser and device used, and a cryptographic fingerprint of the exact document that was on your screen. If you choose to use them, we also record that you entered a passcode we sent you, any photograph taken at the time, and your approximate location. This is set out in full in our Privacy Notice. It protects you as much as it protects us: it is what lets either of us show what was actually agreed.

8. The legal effect of your electronic signature

An electronic signature made through this portal is intended to have the same force and effect as a handwritten one, under 15 U.S.C. § 7001 and California Civil Code § 1633.1 et seq.
