90 days on workmanship · manufacturer's warranty on parts
This is the warranty Breeze Marine Boat Service LLC gives on the work we perform. It is in addition to your rights under California law, and it does not replace them.
We warrant our workmanship for 90 days from the date of the invoice for that work. If work we performed fails within that period because of the way we performed it, we will re-perform it at our cost — parts and labor.
Parts we supply carry the manufacturer's warranty, which we pass through to you and will help you claim under. Where a manufacturer replaces a part under warranty but does not pay the labor to fit it, that labor is chargeable, because we are not paid for it either. We will tell you before doing that work.
Parts you supply carry no warranty from us, and no warranty on the labor to fit them.
This is the part that matters, and doing it in this order is what gets your boat fixed fastest:
Where a failure leaves the vessel unsafe or taking on water, make it safe first and tell us immediately afterwards. Nothing here asks you to leave a boat sinking while you wait for us.
Re-performing the work, or refunding what you paid for it, is the remedy under this warranty, at our election. Our total liability under this warranty does not exceed the amount you paid for the work concerned.
Any claim under this warranty must be brought within 12 months of the invoice date, except where a longer statutory period applies and cannot be shortened.
This warranty is in addition to your rights under California law and does not replace them. Nothing in it waives, limits or modifies any right you have under the Consumer Legal Remedies Act (Civil Code § 1750 et seq.), the Song-Beverly Consumer Warranty Act, or any other statute that cannot be waived by agreement. Nothing in it limits our liability for gross negligence, wilful misconduct, fraud, or personal injury or death caused by our negligence.
